Nested splice/quote fail trying to find value 'apply'

The following code which should work

import scala.quoted._
class Foo {
  val e: Expr[Int] = '(3)
  '{ ~( '{ ~e } ) }
}

fails with

value `apply` is not a member of scala.quoted.Expr[Int]
